Terms of Service

The rules of the game. These terms govern your use of every PunisherGames game, app and this website. By installing or playing, you agree to them — so please give them a read.

01Acceptance of these terms

These Terms of Service ("Terms") are a legal agreement between you and PunisherGames ("we", "us"). They apply to all games and apps we publish (the "Games") and to punishergames.com (together, the "Services").

By downloading, installing, accessing or using any of the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

02Eligibility

You must be old enough to consent to the processing of your personal data in your country (13 in most countries, 16 in some EU countries) to use the Services, unless a Game is specifically designed for children. If you are under the age of majority where you live, you must have permission from a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Services, including any purchases.

03Your licence to play

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download, install and use the Games on devices you own or control, for your personal, non-commercial entertainment.

You may not:

  • Copy, modify, distribute, sell, rent or sublicense any part of the Services.
  • Reverse engineer, decompile or disassemble the Games, except where the law expressly permits it.
  • Create or use cheats, bots, hacks, mods, automation or any unauthorised third-party software that interacts with the Games.
  • Exploit bugs or glitches — please report them to us instead.
  • Use the Services for any unlawful purpose.

04Accounts

Some Games let you create an account or sign in with Google Play Games Services, Game Center or another provider. You are responsible for keeping your login credentials secure and for all activity on your account. Tell us right away at contactpunishergames@gmail.com if you suspect unauthorised access.

Accounts are personal. You may not sell, trade, share or transfer your account. You can delete your account at any time — see Delete Account.

05Virtual items & currency

Games may include virtual currency (such as coins or gems) and virtual items (such as skins, boosts or levels) that you earn or buy ("Virtual Items").

  • Virtual Items are licensed, not sold. You do not own them, and they have no real-world monetary value.
  • Virtual Items cannot be exchanged for real money, goods or anything of value, and cannot be transferred or sold outside the Game.
  • We may change, rebalance or discontinue Virtual Items as part of running the Game. Where we remove a paid item, we will try to provide a reasonable alternative or notice where required by law.
  • Virtual Items may be lost if you delete your account, if the Game is uninstalled without a linked account or cloud save, or if your account is terminated for breaching these Terms.

06Purchases & refunds

In-app purchases and premium Games are sold through Google Play, the Apple App Store or another platform. The platform processes payment, and its terms of sale apply in addition to these Terms. Prices are shown in the store before you buy and may include applicable taxes.

  • Refunds: refunds are handled by the platform you bought from. For Google Play, see Google Play's refund policy. For the App Store, visit reportaproblem.apple.com.
  • Subscriptions: if a Game offers a subscription, it renews automatically until you cancel in your Google Play or App Store subscription settings. Cancelling stops future charges; the current period remains active until it ends.
  • Missing purchase? Try "Restore purchases" in the Game's settings, or email contactpunishergames@gmail.com with your order ID and we'll sort it out.
  • Nothing in these Terms limits any statutory rights you may have as a consumer.

07Advertising

Free Games may display ads, including optional rewarded ads that grant in-game rewards. We do not guarantee a reward if an ad fails to load or is not watched in full. Third-party ads are the responsibility of the advertiser. See our Privacy Policy for how ads use your data and how to control ad personalisation.

08Player conduct

We want our Games to be competitive, fun and safe. When using the Services, you agree not to:

  • Harass, threaten, bully, impersonate or discriminate against other players or our staff.
  • Post content that is hateful, sexually explicit, violent, illegal or that infringes others' rights.
  • Share personal information about yourself or others in public chat.
  • Cheat, manipulate leaderboards, collude, or abuse matchmaking.
  • Spam, advertise or solicit other players.
  • Disrupt or overload our servers or networks, or attempt to gain unauthorised access to them.

09Player content

If a Game lets you create or share content (such as nicknames, chat messages or custom levels), you keep ownership of it, but you grant us a worldwide, royalty-free, non-exclusive licence to host, use, display and distribute it as needed to operate and promote the Games. You are responsible for your content and confirm you have the rights to share it. We may remove any content that breaches these Terms.

10Intellectual property

The Services — including all games, code, artwork, characters, music, sounds, text, logos and the PunisherGames name and hexagon "P" mark — are owned by PunisherGames or our licensors and protected by copyright, trademark and other laws. Except for the licence in these Terms, no rights are granted to you.

If you believe content in the Services infringes your copyright, please email contactpunishergames@gmail.com with details of the work, where it appears, and your contact information.

11Third-party services

The Services may include or link to third-party services such as Google Play Games Services, Game Center, ad networks or social platforms. Those services are governed by their own terms and privacy policies, and we are not responsible for them.

12Updates & availability

We regularly update our Games to add content, fix bugs and improve balance. Some updates may be required to keep playing. We may modify, suspend or discontinue any Game or feature at any time. If we permanently shut down a Game with paid content, we will give reasonable advance notice in the Game or on this website.

Online features require an internet connection and may occasionally be unavailable due to maintenance or events outside our control.

13Suspension & termination

You can stop using the Services at any time. We may suspend or terminate your access, reset progress, or remove Virtual Items if you seriously or repeatedly breach these Terms, if required by law, or to protect other players. Where reasonable, we will tell you why and give you a chance to respond. Sections that by their nature should survive termination (such as Intellectual property, Disclaimers and Limitation of liability) will survive.

14Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free or free of harmful components, or that your progress or data will never be lost.

15Limitation of liability

To the fullest extent permitted by law, PunisherGames will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or Virtual Items, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50.

Some jurisdictions do not allow these limitations, so they may not fully apply to you. Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for death or personal injury caused by negligence, or for fraud.

16Indemnity

To the extent permitted by law, you agree to indemnify and hold PunisherGames harmless from any claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.

17Governing law & disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of Allahabad (Prayagraj), Uttar Pradesh, unless the mandatory consumer protection laws of your country of residence give you the right to bring a claim in your local courts.

18Changes to these terms

We may update these Terms from time to time. We will post the updated version here and change the "Last updated" date. For material changes, we will notify you in the Game or by other appropriate means. Continuing to use the Services after changes take effect means you accept the updated Terms.
